Terms & Conditions

1) About Palace Stays

Palace Stays (“we”, “us”, “our”) is a platform that lists and facilitates bookings for hotels located in historic palaces and other heritage properties (“Properties”). We may operate as an online travel agent, marketplace, or, in some cases, as the merchant of record for select reservations. These Terms & Conditions (“Terms”) govern your access to and use of our website and services (collectively, the “Services”).

2) Acceptance of Terms

By accessing or using the Services, making an inquiry, or completing a reservation, you agree to these Terms and any additional terms shown at booking (e.g., rate rules, property policies, cancellation and payment terms). If you do not agree, do not use the Services.

3) Eligibility

  • You must be at least 18 years old and legally capable of entering into contracts.
  • You confirm any information you provide is accurate and complete.

4) Booking Process & Contract

  • Reservations are subject to availability and the Property’s acceptance.
  • Your contract may be with the Property, with Palace Stays, or with another supplier indicated at checkout.
  • Special requests (e.g., bed type, view, late check-in) are not guaranteed unless expressly confirmed in writing.

5) Accessibility

Given the historic nature of many Properties, full accessibility cannot be guaranteed. Please contact us or the Property in advance to discuss needs; we will endeavor to assist where feasible and lawful.

6) Health, Safety & Well-Being

  • Follow onsite safety instructions and heritage preservation signs.
  • Certain areas may be restricted; children must be supervised at all times.
  • Guests are responsible for their personal health needs, medications, and travel insurance.

7) Third-Party Services & Experiences

Transportation, tours, spa, dining, and other services may be provided by third parties or the Property. We are not responsible for such services unless expressly stated as provided by Palace Stays. Their own terms apply.

8) Travel Requirements

Guests are solely responsible for complying with visa, permit, and other travel requirements, as well as any governmental regulations applicable to their journey and stay.

9) Force Majeure

We and the Properties shall not be liable for delays, cancellations, or failures caused by events beyond reasonable control, including but not limited to acts of God, government actions, pandemics, strikes, or infrastructure failures.

10) Intellectual Property

The website content, branding, and materials of Palace Stays are protected by intellectual property laws. You may not copy, distribute, or create derivative works without prior written consent.

11) User Content

  • If you submit reviews, photos, or feedback, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with the Services.
  • You warrant you own or have rights to any content you submit and that it does not infringe third-party rights or violate law.

12) Privacy

We handle personal information in accordance with our Privacy Policy, which explains what we collect, how we use it, and your choices. Please review it before using the Services.

13) Liability & Disclaimers

  • To the maximum extent permitted by law, the Services are provided “as is” and “as available.”
  • We are not liable for indirect, incidental, special, or consequential losses, loss of profits, or loss of data.
  • Our aggregate liability arising from or related to the Services shall not exceed the total amount paid by you for the reservation giving rise to the claim.
  • Nothing in these Terms excludes liability that cannot be excluded under applicable law.

14) Indemnification

You agree to indemnify and hold harmless Palace Stays, its affiliates, and partners from any claims, damages, or expenses arising out of your breach of these Terms or applicable laws, or your misuse of the Services.

15) Changes to the Services or Terms

We may update the Services and these Terms from time to time. Material changes will apply prospectively and will be indicated by updating the “Last updated” date.

16) Governing Law & Jurisdiction

These Terms are governed by the laws of India. Unless otherwise required by law, you agree to the exclusive jurisdiction of the courts located in New Delhi, India, for any disputes arising out of or relating to these Terms or the Services.

17) Dispute Resolution

Before filing a claim, you agree to first contact us to attempt to resolve the dispute informally within 30 days. If unresolved, the dispute will proceed in the courts identified above unless an alternative process is mutually agreed in writing.

19) Severability & Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force. These Terms, together with any booking-specific conditions, constitute the entire agreement between you and us.
